Overview

From 1st April 2008 Companies and Organisations can be found guilty of Corporate Manslaughter as a result of serious management failures that result in a gross breach of duty of care.

In the past, an organisation could only be convicted of manslaughter if the prosecution could establish exactly who were the controlling minds of the business and then show that they were at fault.

With large Corporates this was virtually impossible. Take for example the Herald of Free Enterprise – Marchioness incident.

The new Act changes this and organisations now face the risk of unlimited fines if they are held liable for anyone's death.

We explain how this can impact your business by looking at the key requirements of the Act from the point of view of managers and controllers. We then demonstrate the legal requirements, together with the practical implications and the steps that may be necessary to avoid criminal liability.

This short course is designed to inform and advise Directors and Senior Managers about their new responsibilities and the consequences of their success or failure to discharge them. It covers current and future trends in legal responsibility and provides practical help for Directors to steer their companies successfully through this minefield.
